MESSAGE FROM THE PRESIDENT

Mark Schrager

Dear Colleagues and Honorable Judges:

Our last dinner meeting was truly enjoyable and particularly appreciated by many of our young members. Larry Smith, CEO of the Montreal Alouettes Football Club is a greatly sought after motivational speaker. We were fortunate to have him as our guest speaker.

The Young Bar Cocktail held on November 15, 2007 was a smashing success with approximately 50 attendees including many law students/future members of the Society. Many thanks to our sponsors and hearty congratulations to Mara Greenstone, Alyssa Yufe and Heather Michelin for their fabulous organizational efforts. The importance of this and every event which encourages young members to support and become active in the Society should not be underestimated.

Our next programme which is the Human Rights Lecture will feature a panel discussion on “Reasonable Accommodation” moderated by Madam Justice Carol Cohen. The members of the panel are Messrs. Jack Jedwab, Executive Director of the Association for Canadian Studies, Prof. Jean-François Gaudreault-DesBiens of the University of Montreal and our own Me Julius H. Grey. You can download the Dinner Invitation here.

Needless to say this is the salient legal, political and sociological subject of the day and the programme promises to be interesting and enriching.

Please mark the upcoming dinner meetings in your 2008 calendar:

January 29th “Cross-Examining the Expert Witness” – Gérald R. Tremblay and Paul Levine
April 3rd – Madam Justice Rosalie Abella
June 18th – Edward L. Greenspan, Q.C.
Happy Chanukah to all!

Sincerely,

Mark Schrager
President

REVIEW OF THE HENRY STEINBERG MEMORIAL LECTURE

Dorith Toledano

It was with brio that Larry Smith began his speech about “leadership, balance, and values” at the Lord Reading Law society, as he walked in between the guests tables mixing and talking “with the people” as he says and not “to the people.”

With resepct to leadersip, Mr. Smith explained how he believes that the “most important role we play is that of our own life.” After fifteen months of self examination when asked to retire by “Bob”, Mr. Smith affirmed that in order to play this role we need a sense of purpose of our mission , we need to be able to answer the question of “why am I here?”

We can only become confident when a direction is given to our lives. We can only be competent/powerful when we have knowledge. It is the balance between power and and direction that will distingush us as a Leader. To reach that equilibrium, we need to keep looking at ourselves everyday, alone.

Mr. Smith continued, explaining in a very expressive manner that there are too few young people nowadays that are able to take over the Leadership while striving to achieve that balance between competency and consciousness, between technical competency and strong interpersonal skills.

Last but not least, he adressed the issue of values, the very foundation on which both balance and leadership ways. What he shared with us was the regret that the very sense of values today is corrupted as the younger generation seems to use the involvment in one’s community to to be able to say that they know a Steve Bronfman or other influential figure.

It was with simplicity yet eloquence and while sharing his own life experience with us that he explained how consciousness and competency as well as a good life plan determined by a sense of purpose leads to stong leadership, balance and sense of value.

MESSAGE FROM THE PRESIDENT

Mark Schrager

Dear Colleagues and Honorable Judges:

There was excellent attendance at our first event. Shimon Fogel delivered the Alan B. Gold Memorial Advocacy Lecture on the topic of “Feeling Good or Doing Good: Successfully Navigating the Pro-Israel Advocacy Challenge”. Mr. Fogel succeeded in explaining the strategy of advocating the case for Israel in a clear and entertaining manner.

Our next programme will be held on October 30th, 2007 when Mr. Larry Smith, the CEO of the Montreal Alouetttes Football Club will be delivering the Henry Steinberg Memorial Lecture on the subject of “Leadership, Balance, and Values.” You can download the Dinner Invitation here.

The Board of Directors of the Society has decided that the celebration for the Society’s 60th anniversary will be held in September 2008. A special sub-committee under the chairmanship of Ian Solloway, one of our Past Presidents, has been formed. The sub-committee has already met and planning for this special event has commenced. We should all continue to be proud of the vibrancy and longevity of the Lord Reading Law Society and we intend to celebrate this with great enthusiasm.

I look forward to seeing you on October 30th.

Sincerely,

REVIEW OF THE ALAN B. GOLD MEMORIAL ADVOCACY LECTURE

Allen Mendelsohn

On September 24th, Shimon Fogel, CEO of the Canada-Israel Committee brought an important discussion of advocacy to the Society with a lecture entitled “Feeeling Good or Doing Good: Successfully navigating the Pro-Israel Challenge.” His talk was both entertaining and informative.

Jason Caron beautifully introduced Mr. Fogel with some great stories arising from his personal relationship with him. He described Mr. Fogel as “our community’s secret weapon.”

Mr Fogel began with a nice story about Alan B. Gold, who taught him innumerable life lessons. One of the highlights was the lesson, told to him in shul, that “if you don’t behave, you’ll learn your bar mitzvah in jail.”

The focus of his talk was a discussion of three approaches to advocacy. These were feeling good, the righteous narrative, and the shared values strategy. He found that the third approach with resepct to Israel was almost too successful, requiring the advocates to go beyond the politicians now and straight to the people.

After concluding with a nice parable about the lion and the gazelle (moral of the story: “run like hell!”), a spirited Q and A followed. The questions touched on one-state solutions, conflict management and resolution, and Israeli vs. Jewish politics.

Other Announcements

A special invitation to our members aged 20-40:

“Remembrance alone is not enough. We must remember, educate, and act” reads the Marcher’s Declaration, written by participants of the March of the Living. The March of the Living takes place on Yom HaShoah, Holocaust Memorial Day, when thousands of Jews will gather in Auschwitz and march to Birkenau. Shortly after, you will travel to Israel for Yom HaZikaron, Israel Memorial Day, and Yom Ha’Atzmaut, Israel Independence Day. The March symbolizes the will and resilience of the Jewish people; we survived the Holocaust and forever vow, “Never Again.”

March of the Living is typically open to Grade 11 students. Given that 2008 will mark the Israel’s 60th anniversary, Montreal will take a Young Adult delegation to Poland and Israel for this very special commemoration. BE A PART OF THE JOURNEY!

MESSAGE FROM THE PRESIDENT

Mark Schrager

Dear Colleagues and Honorable Judges:

Members of the executive have been working to put together a stimulating speakers programme for the coming season. Our first dinner meeting will be held on September 24th, 2007 when Mr. Shimon Fogel will deliver the Alan B. Gold Memorial Advocacy Lecture. Mr. Fogel is the Chief Executive Officer of the Canada-Israel Committee which is the official representative of the organized Canadian Jewish community on matters pertaining to Canada-Israel relations. The title of his speech is: “Feeling Good or Doing Good: Successfully Navigating the Pro-Israel Advocacy Challenge.”

We have reproduced the letter sent by the Society to Louise Arbour, the United Nations High Commissioner for Human Rights. Madame Arbour is a past recipient of the Lord Reading Law Society Human Rights Award. Our letter calls upon Madame Arbour to speak out against the almost exclusive censures of Israel issued by the United Nations Human Rights Council. Please read the letter and her reply. The executive is committed to maintaining the Society’s visibility in the community at large and I urge you to contact me should you wish to bring our attention to any other issue which you consider relevant to the Society’s mandate.

On a more mundane note, you should have received by now your invoice for annual membership in the Lord Reading Law Society. Please attend to payment as soon as possible. The receipt of membership dues are essential to balancing our budget. You can also download the invoice here.

I look forward to a stimulating speakers programme and I encourage our members to attend. Let me also remind the membership that our speakers are volunteers and it is incumbent upon us to treat them as we would guests in our homes. Questions put to our speakers should be posed with this in mind.

I look forward to seeing you at our first event on September 24th.

Shana Tova to all our members.

Sincerely,

Mark Schrager
President

Report of the Lord Reading Career Advancement Committee

The Career Advancement Committee had a very successful year. The Committee was contacted by 15 candidates. The members met with the candidates to determine their interests and then networked their contacts to try and find possible fits.

Members of the committee are unanimous in stating that the experience was extremely rewarding. In most instances, very little was required in order to enable candidates to properly assess their job opportunities, make contacts and find a successful placement.

We wish to make our members aware that many of our applicants are willing to complete their stage with little or no remuneration. We strongly encourage you to consider this as both a service and an opportunity for both the employee and the employer.

Senior members who are considering scaling down their workload are encouraged to consider contacting one of our candidates. The transition can be done at affordable cost and benefits both parties.

Many of our candidates will be happy to take short-term positions such as maternity or sick leave replacements.

There are job opportunities currently available and any of the members of the committee will be more than happy to assist their colleagues and future colleagues in their career search.

We wish to thank the Lord Reading Law Society for their support and forward thinking in allowing us to establish this committee.

REVIEW OF THE MARCH 22ND DINNER-MEETING

    Allen Mendelsohn

On March 22nd, the Society was treated to an interesting lecture from the Honourable James Farley, whose talk was entitled Globalization and the Future of the Practice of Law… or the Good Old days are Over. After a nice Passover message from our President, there was a warm introduction by Max Mendelsohn. He talked about Judge Farley’s 3 C’s – communication, cooperation, and common sense.

Judge Farley talked about the globalization of the economy. This had all sorts of implications for commercial law, an in particular international insolvency.

He discussed the numerous institutions that are attempting to deal with these issues. These included the NAFTA Project, UNCITRAL, and assorted protocols. He said things are problematic, but better than they were 15 years ago. He closed by calling these the “good new days” of cross-border and cross-jurisdiction litigation, as courts are more willing to cooperate with each other.

    Message from the President

    Reisa Teitelbaum

On March 22nd, we will be welcoming the Honourable James Farley, Q.C. who will speak on “Globalization and the Future of the Practice of Law….or, The Good Old Days Are Over”.

The lecture will include a discussion on the benefits (and potential dangers) of globalization and the fact that there is no going back to the “good old days”. Given the increase in world trade and investment – coupled with the “instantaneous” way that commerce now works, how best can the legal community assist business and society in coping with cross-border problems, both preventive and remedial in “real time”. The topic will be of great interest not only to those involved in the insolvency field but to all of us involved in other areas such as class actions, securities litigation and corporate/commercial disputes.

Justice Farley joined McCarthy Tétrault following an illustrious 17-year career as the supervising judge of the commercial list of the Ontario Superior Court of Justice. He has been at the forefront of many major commercial insolvencies, including Air Canada, Eatons, and Stelco.

I look forward to having you all join me for the evening with the Honourable Mr. Justice James M. Farley.

I would also like to take the opportunity of wishing you all a happy Passover, which holiday is soon upon us. Passover is a celebration of renewal and freedom, our freedom from slavery in Egypt. Let us not forget to celebrate our freedom and work towards the freedom of all mankind.

THE IMPACT OF THE PEOPLES DECISION – A Review of the Annual Students Dinner

    Allen Mendelsohn

On February 13th, the Lord Reading celebrated its annual student dinner with an informative and insightful panel discussion of Corporate Governance in Canada in light of the SCC’s decision in Peoples v. Wise.

Society President Reisa Teitelbaum began the evening focusing on student and stagiaires by joking that it was “the only night this year when our average age goes down.” She went on to celebrate scholastic achievement by introducing and congratulating the Lord Reading scholarship winners, John Brighten from McGill and Julien Gratton from Université de Montréal.

The panel was introduced by Justice Benjamin Greenberg, who was the trial judge in the case. Of course, given his duty of judicial reserve, he said he could not add anything to the discussion.

Gerald Kandestin, who acted for Ernst & Young (Peoples’ trustee), explained the background of the case, including the CBCA articles and the appropriate provision of the Bankruptcy Act that got them into Bankruptcy Court. Eric Lalande, who acted for Wise, explained the facts from his perspective, and described the importance of the decision with respect to directors liability in bankruptcy matters, and explained how the SCC held that a fiduciary duty is owed to the corporation exclusively.

Ian Rose, who acted for Chubb Insurance, explained the Business Judgment Rule, upheld by the SCC, and how it means that the courts will support the decisions of directors. There is no violation of the CBCA provisions in question if the business decisions were reasonable, and if reasonable due diligence was performed. So it was concluded that the case would not open the floodgates for directors’ liability.

The panel was thanked by Mark Schrager, and another successful student dinner was over. The Society would like to thank the students and stagiaires for attending, and we hope to see them return in the future and become full-time members of the Lord Reading.

April 1997 – A Kinder, Gentler Old Judge

From U.S. Senior District Judge Lucius D. Bunton, III – who bills himself as “a kinder, gentler old judge” in the newsletter he writes for the district judges of the fifth circuit – this excerpt:

The Court: Mr Henry, two things. Donna is a great court reporter, and I’m sure she got all that down, but I’ve told you before my hearing aids can just listen so fast.

    Mr. Henry: All right.

The Court: And I was in Portland, Ore. last week, and I lost one of those things. So if you see me cocking my head to the right, it’s not because I like to look at that jury over there in the box; it’s because the only hearing aid that I have left is in my right ear. So if you’ll just slow down a little bit, I think I can get most of it in that right ear.

Then later, in the closing arguments:

Mr. Mears: Your honor, if I appear to wink at you it’s because I have got a problem. I lost a contact last night. So, like you, I’m working on half of what I need. And sometimes I have to blink in order to see through these glasses.

The Court: I’ll turn my deaf ear to your blind eye.

Mr. Mears: I’m sure there are a lot of people who would think that would be progress.

    MESSAGE FROM THE PRESIDENT

    Reisa Teitelbaum

As a society, part of our objectives is to foster and recognize scholastic excellence by law students. This is done through the funding of prizes at both the McGill and Université de Montréal law faculties.

At McGill, the prize is awarded to the student with the highest standing in the first year. At the Université of Montréal, the prize is awarded to the student with the highest standing in constitutional I and II. This year’s recipients of the prizes are Andrew John Brighten (McGill) and Julien Gratton (Montréal).

February 13, 2007 is our annual students’ lecture, where we not only pay tribute to the winners of the two prizes, but we welcome students on their journey towards the legal profession. These future lawyers will be an essential part of our future membership and it is important for each of us to make them feel welcome.

At the students’ lecture, we will be welcoming Me Gerald Kandestin, Me Eric Lalanne and Me Ian Rose. The topic of the evening is “Corporate Governance in Canada. The Impact of the Peoples Department Stores Inc.’s decision”. All three lawyers were involved in the litigation.

It is sure to be a wonderful evening and I look forward to seeing you all.

WHERE HAVE ALL THE ADVOCATES GONE? – A Review of the Annual Human Rights Lecture

    Allen Mendelsohn

On December 12, Fo Niemi, Co-Founder and Director-General of the Centre for Research-Action on Race Relations, was a truly worthy recipient of the Society’s Human Rights Award. Humbled by the award and deferring all praise to his colleagues, Mr. Niemi also challenged the room by focusing on the question found in this review’s title.

President Teitelbaum began the evening with some poignant words about Hanukkah as a “story of freedom and hope” that tied nicely into the evening. Mr. Niemi was introduced by Morton Bessner who described him as one of the most deserving citizens of our community.

Mr. Niemi began by thanking the Society for the honour, and getting a nice laugh when relating his colleague’s question “does it come with a check?” He said he felt “really humbled” especially considering past recipients such as Irwin Cotler and Louise Arbour. He described his past human rights involvement and some nice stories about people who influenced him, such as Herbert Marx and David Berger and Sheila Finestone, who were able to make a difference.

He then jumped into the core of his talk. He said civil liberties are still at risk, and that “human rights” and “social justice” may be bad words now. Poverty and court defendants are overwhelmingly minority represented. Immigration has changed Quebec society, and there are things in society that need to be changed.

But the problem is the same names always come up when talking about advocates to these issues – Steven Slimovitch and Julius Grey. Where are those under 40? Where is the so-called “iPod Generation?” It is this new generation that needs to start taking the lead, and they are not. The torch needs to be passed, because as Mr. Niemi said, “silence and indifference have made this fight difficult.” Indifference is more dangerous than anger and hatred.

Mr. Niemi was ably thanked by this reporter and received the Society’s Human Rights Award from President Teitelbaum. His humility and challenge to young lawyers left us all with something to think about.
